Copyright, Third-Party Content and Infringement Notification Policy
1. Purpose and Scope
PackageTourTurkey.com (the “Platform”) is operated by Romos Turizm Bilişim Dış Ticaret Limited Şirketi (the “Operator”).
The Operator respects the intellectual property rights of authors and other rights holders. Notifications concerning content published on the Platform are assessed in accordance with applicable law and the circumstances of each case.
This policy explains the notification and review procedure concerning photographs, videos, text, tour itineraries, blog articles, graphics and other content.
2. Nature of the Platform and the Operator’s Role
2.1. Platform Activities
The Platform does not provide online payment facilities or functionality for completing reservations directly. No products or services are sold directly through the Platform, and no revenue is generated through advertising or similar methods.
The Platform is used to promote tourism services, inform visitors and publish tourism-related content. This may include programmes supplied by partner travel agencies and tour operators, information about professional tourist guides and articles supplied by independent writers.
2.2. Third-Party Content and Hosting Role
The Platform enables the publication of tour programmes, promotional materials and blog content supplied by partner agencies, tour operators, service providers, independent writers and other third parties.
In relation to third-party content, the Operator acts as a hosting provider (“yer sağlayıcı”) to the extent that its activities fall within the relevant definition under Turkish Law No. 5651.
Publication on the Platform does not, by itself, mean that the Operator created the content, is its author or has acquired all intellectual property rights in it.
The Operator’s legal capacity and responsibilities are assessed separately for each item of content, taking into account its source, how it was supplied and published, the Operator’s actual role and applicable law. Obligations concerning content directly created or supplied by the Operator remain unaffected.
2.3. Permissions and Content Sources
Permissions and rights information concerning third-party content are assessed by reference to available agreements, licences, correspondence, delivery records and other evidence.
Where an infringement is alleged, the relevant content provider may be asked to supply an explanation or evidence of permission or licensing. The Operator reserves its contractual and statutory rights of recourse against the relevant content provider.
This policy does not, by itself, create a new contract with third parties or impose obligations absent from existing agreements.
3. Copyright Infringement Notifications
Rights holders and authorised representatives who believe that content on the Platform infringes their rights may contact copyright@romostravel.com . To assist review, notifications should include, where available:
- The notifying party’s name or business name and contact details.
- Evidence of authority where the notification is submitted on another party’s behalf.
- A clear identification of the work and evidence supporting ownership or authority to exercise the relevant rights.
- The exact URL and location of the disputed content.
- The grounds for the allegation and any relevant licensing information.
- A clear statement of the requested action.
- For monetary claims, the legal basis, calculation and supporting comparable licences or other evidence.
Registration certificates are not the only evidence accepted. Other relevant information and evidence may be considered. Additional information may be requested where necessary. An otherwise sufficiently identifiable notification will not be disregarded solely because of formal omissions.
Please do not submit irrelevant documents, unnecessary personal data or special categories of personal data.
4. Review and Available Measures
Notifications are assessed without undue delay, taking into account the content, available evidence and applicable statutory time limits. The Operator may examine permission records and request explanations from the notifying party or the relevant content provider.
As appropriate, content may be temporarily or permanently removed, access may be restricted, or content or attribution may be corrected. Content may be restored where legally appropriate following review of objections and supporting evidence.
Binding decisions of competent authorities take precedence. Requests for further information do not suspend mandatory legal deadlines or the obligation to take necessary measures.
Removal, restriction, correspondence or other precautionary measures do not, by themselves, constitute an admission of ownership, infringement, fault, liability or the amount claimed. The Operator reserves its rights of defence and objection.
5. Notice-and-Takedown Procedure and Contact Channels
Where applicable, the Operator takes account of the notice-and-takedown procedure under Additional Article 4 of Turkish Law No. 5846 on Intellectual and Artistic Works.
Under that procedure, the affected rights holder first requests that the information content provider cease the infringement within three days. If the infringement continues, the statutory procedure involving an application to the public prosecutor and a request to the service provider to discontinue service to the infringing content provider may become applicable.
Notifications should preferably be sent to copyright@romostravel.com for registration and prompt routing. General information, sales and reservation addresses are not designated for copyright notification handling.
This arrangement does not invalidate notifications actually received by the Operator or other legally valid notification and service channels. This policy does not restrict access to competent authorities or create a prerequisite for a claim or complaint that is not prescribed by law.
6. Monetary Claims and Reservation of Rights
Receipt of an allegation or payment demand does not, by itself, constitute acceptance of that allegation or demand. The Operator may examine ownership, representation, the nature of use, applicable permissions and the legal and evidential basis of the amount claimed.
Disputes concerning rights, infringement, liability or amounts claimed are subject to assessment by the courts and other competent authorities under applicable jurisdictional rules. Criminal investigations are conducted by the competent public prosecutors in accordance with law.
The parties’ rights of application, defence and objection, and the Operator’s statutory obligations to take necessary measures, remain unaffected.
7. False or Abusive Notifications
Where the relevant legal conditions are met, the Operator reserves its rights concerning forged or misleading evidence, knowingly false claims of ownership or representation, and unlawful abuse of legal procedures, including claims for damages and litigation costs.
Rejection of a notification, disagreement with a requested amount or a judgment in the Operator’s favour does not, by itself, establish bad faith.
8. Records and Personal Data
Notification-related personal data and records are processed in accordance with applicable data protection law for reviewing requests, communicating with relevant parties, complying with legal obligations and establishing, exercising or defending legal rights.
Records are retained only for the periods necessary for those purposes. Disclosure to competent authorities or legal advisers is limited to what is legally appropriate and necessary. Removal from public access does not require destruction of records that may lawfully be preserved as evidence.
This policy does not replace any applicable privacy notice or statutory data protection information requirements.
9. Legal Nature of this Policy
This policy explains the notification and review process. It does not exclude mandatory legal obligations or deprive rights holders of rights granted by law.
Publication of this policy or use of the Platform does not constitute a waiver of access to judicial authorities or acceptance that the Operator is exempt from liability. Legal status and responsibility are determined according to applicable law and the circumstances of each case.
